2.1 Information You Provide Directly

We collect information that you voluntarily provide to us when you create an account, fill out forms, request services, communicate with us, or otherwise interact with our Services. This includes:

  • Contact Information: Name, email address, mailing address, phone number (including mobile number). We collect your mobile phone number when you opt in to receive text messages, submit a contact form, sign a lease, or engage with our real estate services.

  • Account Information: Username, password, and account preferences you establish during registration.

  • Property Information: Property addresses, property details, lease terms, rental amounts, and related documentation you provide in connection with property management or real estate services.

  • Financial Information: Payment card details, bank account information, and billing addresses. Financial data is processed through PCI-compliant third-party payment processors and is not stored on our servers in unencrypted form.

  • Identification Information: Government-issued identification, Social Security numbers, or taxpayer identification numbers when required for tenant screening, lease agreements, or tax reporting purposes.

  • Communications: Messages, inquiries, feedback, support requests, and any other content you send to us via email, phone, text, web forms, or through the Services.

  • SMS/Text Message Consent Data: When you opt in to our text message program, we collect and record your mobile phone number, your opt-in consent status (opted in or opted out), the date and time of your opt-in, the specific method by which you opted in (e.g., web form submission, keyword texted to a short code, paper form), the specific campaign or program you opted in to, and any subsequent opt-out requests and their timestamps.

2.2 Information Collected Automatically

3.1 Detailed Use Descriptions

  • Service Delivery: To provide, maintain, and improve our property management and real estate services, process transactions, manage tenant and landlord accounts, coordinate maintenance requests, and facilitate real estate transactions.

  • Transactional Communications: To send you service-related messages including appointment confirmations, showing reminders, lease notifications, maintenance updates, payment confirmations, and security alerts. These communications are necessary for the performance of our services and are not marketing.

  • SMS/MMS Marketing Communications: To send you promotional text messages about new property listings, open house announcements, price reductions, market updates, seasonal promotions, and real estate tips — only with your prior express written consent as described in Section 4. We use your mobile phone number solely for the messaging purposes you consented to at opt-in, and your opt-in data is used to verify and document your consent as required by the Telephone Consumer Protection Act (TCPA).

  • Email and Telephone Marketing: To send you promotional emails and make marketing calls about our services, new listings, market updates, and special offers, subject to your consent and opt-out preferences.

  • Personalization: To tailor your experience, deliver content and property recommendations relevant to your interests and search history, and customize marketing communications.

  • Tenant Screening: To evaluate rental applications through background checks, credit reports, employment verification, and reference checks as permitted by the Fair Credit Reporting Act (FCRA) and applicable state laws.

  • Legal and Compliance: To comply with applicable laws, regulations, and legal processes, enforce our Terms of Service, protect our rights and the safety of our users, and prevent fraud and abuse.

  • Analytics and Improvement: To analyze usage trends, measure the effectiveness of our marketing campaigns (including SMS campaigns), conduct A/B testing, and improve the functionality and user experience of our Services.

4. TEXT MESSAGE (SMS/MMS) PRIVACY PRACTICES

Because text message marketing is a core component of our communications, we want to be especially transparent about how we handle your mobile information. This section should be read in conjunction with Section 5 of our Terms of Service, which contains the full SMS terms and conditions.

4.1 How You Opt In to Text Messages

You may opt in to our text message program through one or more of the following methods:

  • Website Opt-In Form: By entering your mobile phone number and checking the consent checkbox on any web form on our website that offers text message communications.

  • Keyword Opt-In: By texting a designated keyword (e.g., "REDBEARD" or "JOIN") to our short code or phone number as advertised in our marketing materials.

  • Paper or In-Person Opt-In: By providing your mobile phone number and written consent on a physical form during an in-person meeting, open house, or other event.

  • Account Registration: By checking the SMS consent option during account creation on our platform.

Regardless of the opt-in method, your consent is always voluntary. We will never pre-check opt-in boxes or use deceptive language to obtain your consent.

4.2 What Happens When You Opt In

When you opt in to our text message program, the following occurs:

  • We send you a confirmation message acknowledging your enrollment, identifying Red Beard Property Management / Real Estate as the sender, disclosing message frequency and data rate information, and providing opt-out instructions (reply STOP) and help instructions (reply HELP).

  • We create a consent record in our system that logs your mobile phone number, the date and time of opt-in, the opt-in method and source (e.g., which web form, which keyword, which event), the specific campaign or program, and the language of the consent disclosure presented to you.

  • We begin sending you the types of messages described at the time of your opt-in, in accordance with the disclosed message frequency.

4.3 Collection and Storage of Consent Records

We securely store all SMS consent records using commercially reasonable safeguards, including encryption at rest and access controls limiting personnel who can view consent data. We retain these consent records for a minimum of five (5) years from the date of consent or last interaction, or as otherwise required by applicable law, to demonstrate compliance with the Telephone Consumer Protection Act (TCPA) and related regulations.

4.4 Use of Your Mobile Number

Your mobile phone number will be used solely to send you the types of messages described at the time of your opt-in. These may include marketing messages (new listings, promotions, open houses, market updates), property alerts matching your saved preferences, appointment and showing reminders, transactional notifications (lease updates, payment confirmations, maintenance status), and customer service responses. We will not use your mobile number for purposes unrelated to our Services or beyond the scope of your consent.

4.5 Mobile Information Sharing — No Third-Party Marketing

RED BEARD PROPERTY MANAGEMENT / REAL ESTATE DOES NOT SELL, RENT, LEASE, OR OTHERWISE SHARE YOUR MOBILE PHONE NUMBER, SMS CONSENT STATUS, OPT-IN DATA, OR ANY INFORMATION COLLECTED THROUGH OUR TEXT MESSAGE PROGRAM WITH ANY THIRD PARTY FOR THAT THIRD PARTY'S OWN MARKETING OR PROMOTIONAL PURPOSES.

The only circumstances under which we disclose your mobile information to third parties are:

  • SMS Service Providers: We share your mobile number with our SMS platform provider(s) solely for the purpose of delivering text messages on our behalf. These providers are contractually bound by data processing agreements that prohibit them from using your information for any purpose other than delivering our messages, sharing your information with any other party, or retaining your information beyond the minimum period necessary for message delivery and compliance recordkeeping.

  • Legal Obligations: We may disclose your mobile information when required by law, subpoena, court order, or government regulation, or when necessary to protect the rights, safety, or property of Red Beard Property Management / Real Estate or others.

To be clear: no third party that receives your mobile information from us is authorized to use it for their own text message marketing, telemarketing, or any other promotional purpose.

4.6 Opt-Out and Data Deletion

You may opt out of marketing text messages at any time by replying STOP (or UNSUBSCRIBE, CANCEL, END, or QUIT) to any message from us. Upon opting out:

  • You will receive a single confirmation message verifying your opt-out.

  • We will cease all marketing text messages within forty-eight (48) hours.

  • We will retain your opt-out record (phone number, opt-out date, and method) to ensure we do not inadvertently message you in the future.

  • You may still receive transactional or service-related messages necessary for your active account or lease, unless you contact us to request cessation of all messages.

If you wish to have your mobile number and all associated consent data permanently deleted from our systems, you may submit a written request to us using the contact information in Section 13. We will process deletion requests within thirty (30) days, subject to any legal retention requirements.

5. HOW WE SHARE YOUR INFORMATION

We do not sell your personal information. We may share your information in the following circumstances:

  • SMS Consent Records: Retained for a minimum of five (5) years from the date of consent or last interaction.

  • Tenant Screening Data: Retained in accordance with the Fair Credit Reporting Act (FCRA) and applicable state laws.

  • Marketing Data: Retained until you opt out or request deletion, after which we retain only the opt-out record.

When personal information is no longer needed, we will securely delete or anonymize it.

7. DATA SECURITY AND HANDLING

Protecting your personal information is a priority for Red Beard Property Management / Real Estate. We implement a layered approach to data security using commercially reasonable administrative, technical, and physical safeguards.

7.1 Technical Safeguards

  • Encryption: All data transmitted between your device and our servers is encrypted using TLS (Transport Layer Security). Sensitive data stored in our systems, including financial information and SMS consent records, is encrypted at rest using industry-standard encryption algorithms.

Do Not Track: Our website does not currently respond to "Do Not Track" (DNT) signals from browsers, as there is no industry-accepted standard for how to respond to these signals. However, you may use the opt-out mechanisms described above to manage your preferences.

Please allow up to ten (10) business days for email and telephone opt-out requests and up to forty-eight (48) hours for SMS opt-out requests to be fully processed. Opting out of marketing communications will not affect transactional or service-related messages necessary for your active services.

9.7 Right to Non-Discrimination

We will not discriminate against you for exercising any of your privacy rights. You will not receive different prices, a different quality of service, or be denied service because you exercised a right under applicable privacy law.

We will respond to verified requests within thirty (30) days. If we need additional time, we will notify you of the reason and the expected response date. You may designate an authorized agent to make a request on your behalf, provided the agent can demonstrate valid written authorization.

9.9 California Residents (CCPA/CPRA)

10. CHILDREN'S PRIVACY

Our Services are not directed to individuals under the age of eighteen (18). We do not knowingly collect personal information from children under 18. If we become aware that we have inadvertently collected personal information from a child under 18, we will take steps to delete such information promptly.
